Commercial Overdraft Privilege Protection

Commercial Overdraft Privilege is a special overdraft program in which, at our discretion, you may be offered overdraft protection up to $1,250 as long as you maintain your account in good standing. You will still incur the regular Non-sufficient funds fee for each NSF transaction; however Overdraft Privilege will save you the trouble and expense of having a check returned to a merchant.

If you qualify, Overdraft Privilege will be established on your account in 30 days. As always, you should handle your account properly. Overdraft Privilege may be revoked at any time without notification. Please see the reverse of this sheet for more details.


An insufficient balance can result from several events, such as (1) the payment of checks, electronic funds transfers or other withdrawal requests; (2) payments authorized by you; (3) the return of unpaid items deposited by you; (4) bank service charges and fees; or (5) the deposit of items which, according to the bank’s Funds Availability Policy, are treated as not yet available for final payment. A per item overdraft fee as stated in our schedule of fees may be imposed for covering overdrafts that result from the events previously mentioned. In the event that an insufficient balance does occur, the account must be brought current within 30 days. We are not obligated to pay any item presented for payment if your account does not contain sufficient funds. However, if you maintain your account in good standing (defined as making regular deposits and bringing your account to a positive balance, including payment of all bank fees charged to your account, at least once every 30 days), there are no legal orders, liens, or levies outstanding, and you are not on a loan watch list or in default on any loan or obligation that you owe to the bank, we may approve your reasonable overdrafts as a non-contractual courtesy. In the normal course of business, we generally pay items (checks, drafts, and electronic items) beginning with the highest dollar amount items first. We reserve the right to change the order of payment without notice to you if we suspect fraud or possible illegal activity affecting your account. Also, please be aware that the order of item payment may create multiple overdrafts during a single banking day for which you will be charged our standard overdraft fee as stated in our Schedule of Fees for each overdraft item (paid or returned). You may opt out of the privilege at any time, but you are responsible for any overdrawn balances at the time of opting out. Normally, we will not approve an overdraft for you in excess of the predetermined amount assigned to your account. So as not to exceed your limit, please note that the amount of the overdraft plus the bank’s standard per item overdraft fee as stated in our Schedule of Fees will be deducted from the overdraft limit. We may refuse to pay an overdraft for you and we reserve the right not to pay at any time even though we may have previously paid overdrafts for you. We typically do not pay overdrafts if your account is not in good standing, or if you are not making regular deposits, or if you have too many overdrafts. You will be notified by mail of any non-sufficient funds item paid or returned that you may have; however, we have no obligation to notify you before we pay or return any item. The amount of any overdraft plus our standard overdraft fee as stated in our Schedule of Fees that you owe us shall be due immediately and payable without demand.
It is the policy of First Community Bank to operate in accordance with all applicable safety and soundness standards. Your Account Agreement controls the duties, obligations and rights of the Depositor, the Authorized Signatories and First Community Bank with regard to your checking account. If there is an overdraft paid by us on an account with more than one owner on the signature card, each owner and agent, if applicable, drawing/presenting the item creating the overdraft, shall be jointly and severally liable for such an overdraft plus our standard NSF fee as stated in our Schedule of Fees. The account agreement terms shall control any possible conflicts, if any, between any provision of our overdraft policy and your Account Agreement. We may change any term of this service; however we will give you reasonable notice in writing or by any other method permitted by law.

Overdraft Privilege should not be viewed as an encouragement to overdraw your account. As always, we encourage you to manage your finances responsibly. If you would like to have this service removed from your account, please visit any of our branch locations.

Please note that your Overdraft Privilege limit will not be reflected in your balance provided by the teller, at the ATM or through Resource Online Banking or Xpress Phone Banking.

Limitations: Overdraft Privilege is a non-contractual courtesy that is available to individually/jointly owned accounts in good standing for personal and business use. First Community Bank reserves the right to limit participation to one account per household or business and to discontinue this service without prior notice.
