PrivacyFIRST COMMUNITY BANK, N. A. AND PEOPLE’S COMMUNITY BANK, A DIVISION OF FIRST COMMUNITY BANK, N. A. PRIVACY POLICY Effective May 24, 2005 Introduction First Community Bank, N. A. and People’s Community Bank, a division of First Community Bank, N. A., have established relationships with customers spanning generations of trust. Our customers have chosen to do business with us and we will honor their trust with great care, beginning with the information they have chosen to share with us. We believe our customers’ right to privacy should not be compromised. At the same time, we want to offer our customers an array of financial products and services needed to accomplish their financial goals. We believe we can do both through the Privacy Policy outlined below. In this Policy, we refer to “our affiliates.” When we do, we mean one or more members of the First Community Bank, N. A. family of companies. At present, our affiliated company is Stone Capital Management. When we use words such as “nonaffiliated” or “nonaffiliates,” we mean companies that are not part of the First Community Bank, N. A. family of companies. In addition, “we,” “our,” or “us” refers to First Community Bank, N. A. and People’s Community Bank, a division of First Community Bank, N. A. (including affiliates). Recognition of Customer’s Expectation of Privacy We recognize the customers’ right to privacy and consider the confidentiality and safekeeping of customer information to be one of our fundamental responsibilities. And while information is critical to providing quality service, we recognize that one of our most important assets is our customers’ trust, therefore, confidentiality and safekeeping of customer information is a priority. Information Management Practices Customer information is accumulated from a variety of sources. Some information is provided to us directly by customers themselves. Other information is developed by us as a function of providing a product or service to a customer. Still other information is obtained from outside sources. We limit the collection and use of information about our customers to that which is necessary to administer our business, provide superior service, and offer opportunities that we feel may be of interest to customers. This means information may be used to assist in identifying and mitigating potential risks or loss to us. We may also use information to help identify additional products or services in which we feel customers may be interested. Any information obtained will only be used in accordance with the principles set out within this Policy. Protection of Information We are committed to the security of our customers’ financial and personal information. Our operational and data processing systems are maintained in a secure environment that protects account information from being accessed by third parties. We maintain and grant access to customer information only in accordance with our internal security standards. Maintenance of Accurate Information Our goal is to maintain complete and accurate information on our customers and their accounts. When inaccuracies are brought to our attention, we pledge to investigate and correct any inaccurate or incomplete information in a timely manner. Limitations on Employee Access to Information Each of our employees is required to adhere to the Company’s “Code of Conduct,” which states that customer information is considered private and privileged and is to be used solely for the purpose of providing our customers with the finest service available. Access to customer information is limited to those employees with a business need to know. Employees are educated on the importance of maintaining the confidentiality of customer information. Because of this important responsibility, employees who violate the “Code of Conduct” are subject to disciplinary measures. Restrictions on the Disclosure of Account Information When sharing customers’ nonpublic personal information with affiliates or nonaffiliates, strict limitations are placed on who receives specific information on customer accounts or other personally identifiable data. Unless we obtain a customer’s advance authorization to do otherwise, we will treat the customer’s nonpublic personal information in the following ways: Maintaining Customer Privacy in Business Relationships with Us We will not share information concerning a customer or former customer’s account history or experience with us or our affiliates, except with the customer’s prior permission or otherwise as permitted by law. In some instances, a current or potential customer may disclose or authorize the disclosure of medical information as part of an application for a specific product, such as insurance. In these instances, we will share such information only with those who need to know the information in order to process the application. This information will not be used for other purposes, unless authorized by the customer. Maintaining Customer Privacy in Business Relationships with Outside Parties We do not disclose nonpublic personal information on customers or former customers to anyone, except by their permission or as permitted by law. We may disclose information we collect to companies that perform marketing services on our behalf or to financial institutions with which we maintain joint marketing agreements. If customer nonpublic personal information is provided to outside parties we expect said parties to maintain similar standards for safekeeping of customer information. If a decision is made to sell a particular line of business, for example, credit card accounts, an integral part of that business is the customer database. In these instances, we reserve the right to transfer ownership of such customer databases to the purchaser. Disclosure of Information to Government Agencies The Bank Secrecy Act, Internal Revenue Service Code, Right to Financial Privacy Act, Welfare Reform Act, as well as other laws and regulations require us or our third party service providers, in certain instances, to provide customer information to governmental agencies. Customer information will be disclosed to these entities when required by such laws, regulations, or order of a court. Federal and state laws impose certain mandatory disclosures of customer information on financial institutions and, in these instances; we will comply with laws requiring such production or disclosure. Disclosure of Information to Third Party Litigants Both federal and state laws afford parties to litigation the right to compel the production of information and records from financial institutions and, in certain instances, other third party record keepers. In these circumstances, we will only disclose customer information when required to do so by lawful process or by a court order. Privacy on the Internet Customers or visitors to our Internet site may understandably have valid privacy concerns concerning our services through the Internet. In particular, customers or visitors may be concerned whether their nonpublic personal information will remain secure in an Internet environment and that their information is covered by this Privacy Policy. The following guidelines describe the use of information obtained by us through the Internet: We do not collect nonpublic personal information unless voluntarily and knowingly provided to us, such as by an e-mail or by performing an on-line banking service. If provided with nonpublic personal information via the Internet, it is subject to the same customer confidentiality standards that apply to all other customer account information. The information is not disclosed to anyone, except by customer or visitor permission, or otherwise permitted by law. INTERNET PRIVACY NOTICE Effective March 1, 2004 First Community Bank is committed to protecting the confidentiality of our customers and others visiting our website to provide the highest level of privacy. We do not collect personally identifying information about visitors to our site.
